  1. INTRODUCTION

1.1 The Site allows the reservation of rooms and additional services within the Etigny hotel by customers.

1.2 These General Conditions of Sale (the "" General Conditions of Sale "") are applicable to the reservation of rooms and additional services within the Etigny hotel (the "" Services "") and are those in force on the date confirmation of your reservation on the Sites. They cancel and replace all General Conditions of Sale previously posted online and/or accepted by the Customer.

1.3 Any reservation on the Site requires consultation and acceptance without reservation or condition of the General Conditions of Sale. It is recommended to download and/or print the General Conditions of Sale in order to keep a copy on the day of a reservation, since they are subject to modification.However, any modification occurring after confirmation of a reservation cannot be applied to this reservation.

  • the terms and means of payment accepted,

1.6 The expression "" Customer(s) "" means any natural person who places an order on the Site, as a consumer, for private or professional purposes, but unrelated to the hotel industry.

1.7 Being a consumer, the Customer benefits from rights which may be called into question in the event that the Services are reserved by him in the context of the exercise of a professional, commercial, industrial, artisanal or liberal activity.

1.8 Only Customers (i) having reached the age of majority (eighteen in most countries) and (ii) having the legal capacity to conclude contracts, are authorized to order Services on the Site.

1.9 The information provided by the Site is presented in French, as well as in several foreign languages.


  1. OBJECT

2.1 The General Conditions of Sale define the terms and conditions applicable to online reservations on the Service Site.

2.2 The General Conditions of Sale do not govern the offer, reservation or order of Services offered by entities other than Société Hôtelière d'Etigny, other websites and/or mobile applications.   1. RESERVATION

3.1 The Site offers an online reservation process for hotel rooms for a maximum number of five (5) rooms per reservation, and additional services.

3.2 The accommodation offers presented on the Site are accompanied by an information sheet including:

  • a description of the room(s) concerned,

  • the additional services included in the offer,

  • the cancellation and modification conditions applicable to the reservation,

  • where applicable, the applicable special conditions of sale,

  • the terms and conditions of payment,

  • the General Conditions of Sale.

3.3 The Site occasionally offers commercial offers which are only accessible on the Hôtel d'Etigny Site, to the exclusion of any other third-party site, such as in particular temporary offers called " Best Rate Guaranteed". » or "" Deal "". Where applicable, the Customer is invited to consult the special conditions applicable to these offers, which are brought to his attention at the time of booking. These commercial offers may be modified at any time by the Société Hôtelière d'Etigny, which is only contractually bound by reservations validated by the Customer and cannot be held liable for the modification or withdrawal of a commercial offer on the sites.

3.4 The Customer selects the Services offered on the Site. He is solely responsible for the choice of the Services and their suitability to his needs, so that the responsibility of the Société Hôtelière d'Etignycannot be committed in this regard.

3.5 The Customer can reserve a maximum number of five (5) rooms on the Site. For any reservation of a greater number of rooms or for any other request for services not appearing on the Site, we invite you to contact the Société Hôtelière d'Etigny or the Hôtel d'Etigny directly. In the event of a reservation of six (6) rooms or more, group conditions may be applied, implying in return the payment of a deposit by the Customer and the application of special cancellation and modification conditions. For any information in this regard, please contact the Etigny hotel.

3.6 The reservation is deemed accepted by the Customer at the end of the reservation process.

3.7 The Client certifies the veracity and accuracy of the information transmitted when booking Services. The Etigny Hotel Companyreserves the right not to follow up on any reservation from a person who makes fraudulent use of the Site or who does not respect these General Conditions of Sale.

3.8 Any reservation of more than 5 rooms or 25 nights or more involves special conditions and additional costs.


  1. BOOKING PROCESS

4.1 Reservations are made directly by the Customer on the Site.

4.2 When booking, the Customer must provide a certain number of mandatory data, including certain personal data necessary for the processing of the reservation by the Société Hôtelière d'Etigny, which reserves the right to refuse any reservation in the absence of these data or because it is incorrect.The Client must also indicate the number of people benefiting from the Services, as well as their age, any minor aged over 13 being considered an adult.

4.3 The reservation procedure on the Site includes in particular the following steps:

  • Step 1: Selection on the home page of the Site www.hoteldetigny.com, of the arrival date,

  • Step 2: Opening of a secure page indicating the offers available for the Etigny hotel and the date indicated, and offering the Customer the possibility of specifying or modifying any of the choices made (arrival and departure dates). departure, number of room(s), number of people, etc.),

  • Step 3: Consultation and selection of an offer,

  • Step 4: Selection, if applicable, of one or more additional Services,

  • Step 5: Verification of the details of the reservation, its total price and the applicable conditions and possible modification of the choices made,

  • Step 6: Provision by the Customer of their contact details,

  • Step 7: Entering bank details in the event of a guarantee or prepayment request,

  • Step 8: Consultation and acceptance of the General Conditions of Sale, the Privacy Policy and, where applicable, the special conditions of sale before validation of the reservation by the Customer,

  • Step 9: Validation of the reservation by the Customer.


  1. CONFIRMATION OF THE RESERVATION

5.1 The Site acknowledges receipt of the reservation made by the Customer by sending an e-mail containing (i) the corresponding reservation number, (ii) the summary of the reservation and in particular the Services reserved, the price of the Services , the conditions of sale applicable to the selected price, accepted by the Customer, (iii) the General Conditions of Sale, if applicable, information relating to after-sales service as well as the contact address to which complaints can be presented .

5.2 The reservation is deemed firm and final upon receipt of this reservation confirmation email sent by the Etigny hotel to the Client.

5.3 The duration of the contract concluded between the Client and the Hotel corresponds to the duration of the Accommodation Service provided for in the reservation.


  1. CANCELLATION OR MODIFICATION OF A RESERVATION BY THE CUSTOMER

6.1 Pursuant to article L.221-28   of the Consumer Code, the Services offered on the Site do not allow the exercise of the right of withdrawal provided for in articles L.121-21 et seq. of the Consumer Code regarding distance sales contracts.

6.2 The conditions of sale of the reserved rate specify the terms of cancellation and/or modification of the reservation.

6.3 Reservations with prepayment cannot be subject to any modification and/or cancellation. The sums paid in advance constitute a deposit, they cannot be subject to any reimbursement, which will be indicated in the conditions of sale of the price brought to the attention of the Customer and accepted by him.

6.4 When canceling a reservation is possible, a specific link "" cancel an order» is available on the home page of the Sites, allowing you to cancel a reservation by entering the email address provided during the reservation and the reservation number indicated in the reservation confirmation email.

6.5 Certain commercial offers present on the Site may include special conditions on the cancellation and modification of the reservation, these are detailed in their Special Conditions appearing in the description of the offer.

6.6 In the case of Covid-19 contamination before the stay, no exceptional provision is made to benefit from a cancellation, modification, credit or refund of the reservation. If the customer has paid a deposit, this binds him and implies his obligation to pay the entire stay.


  1. NO SHOW AND INTERRUPTION OF STAY

7.1 Any reservation made on the Site provides for an arrival time of 3:00 p.m. and a departure time of 12:00 p.m.

7.2 If the reserved room is vacated after the required departure time (12:00 p.m.), an additional night will be billed to the Client as a penalty.

7.3 Any interruption of the stay before the departure date planned in the reservation will result in payment of the entire agreed price.


  1. PRICES OF SERVICES

8.1 The price of the Services is indicated on the Site before booking on the offer description sheet, as well as during the booking.

8.2 The prices indicated are per room for the number of people indicated and the period selected and only include the Services strictly mentioned in the reservation.

8.3 The price of each Service is indicated all taxes included (TTC), excluding tourist tax, and details the amount of VAT applicable to the Service.

8.4 The euro is the commercial currency of the reservation, payment must therefore be made in this currency. The prices displayed on the Site in different currencies remain estimates and do not accurately reflect the amount to be paid, indicated in euros when validating the reservation by the Customer. The tourist tax is 1.44 euros per person per night. It must be paid directly on site to the Hotel.

8.5 The prices mentioned on the Site are subject to modification at any time by the Société Hôtelière d'Etigny, without prior notice or notice. Only the price indicated in the reservation confirmation is contractual.


  1. PAYMENT OF THE PRICE

9.1 Unless otherwise specified, payment of the price of the Services is made at the Hotel, at the latest at the end of the stay and in all cases before departure from the establishment. In the event of prepayment, the amounts paid constitute a deposit and cannot be reimbursed to the Customer.

9.2 Furthermore, the Société Hôtelière d'Etigny reserves the possibility of carrying out, in particular upon arrival at the Hotel, a pre-authorization on the Client's bank card in order to guarantee payment of the price of the Services as well as possible consumption or expenses of the Customer on site. The pre-authorization is not an immediate debit but corresponds to a sum blocked on the Client's account, authorized by the bank, which temporarily reduces the balance of the Client's account in order to guarantee the possibility of a subsequent debit.

9.3 In the event of no-show at the hotel, the Customer's bank details provided at the time of booking will be used to settle the corresponding penalties.


  1. HOTEL STAY

10.1 In accordance with current French regulations, the Client may be asked to complete a police form upon arrival at the Hotel. In order to verify whether the Customer must be subject to this formality, proof of identity will be requested.

10.2 The Etigny hotel welcomes, for an additional fee, certain animals as long as they are kept on a leash or in a cage in the common areas of the establishment. For more information on these reception conditions, the Customer is advised to contact the Hôtel d'Etigny directly. For the entire duration of the stay, the animal remains under the entire responsibility of the Customer.For hygiene reasons, animals are not allowed in the dining room.

10.3 During the stay, the Customer undertakes to use the room rented to him reasonably and in good manners. The Hotel may ask the Customer to leave the Hotel without any compensation being paid and to pay in full for the Service reserved, particularly in the event of:

  • behavior contrary to good morals or public order,

  • any damage, deterioration, act of vandalism occurring by him or that of his employees or persons in his charge, during the occupation of the premises, to any movable or immovable property, furnishing, decoration or any other nature present in the Hotel.

In addition, the Client will be required to fully reimburse the damage caused by their actions, the Société Hôtelière d'Etignyhaving all rights and being able to take any useful action in order to obtain compensation for the damage suffered.

10.4 The Société Hôtelière d'Etigny provides Customers with free WiFi internet access in the Etigny hotel.

The Client undertakes to ensure that the computer resources made available to it are not used for fraudulent or illegal purposes, and in particular in order to commit any act of infringement of third party rights and/or illegal downloading of works protected by a copyright or a related right, sanctioned by article L.335-2 of the Intellectual Property Code.


  1. DISLOCATION – FORCE MAJEURE

11.1 In the event of unavailability of the room reserved in the Etigny hotel, the Société Hôtelière d'Etigny reserves the right to have the Client fully or partially accommodated in a Hotel of equivalent or higher category and offering Services of the same nature.The transfer will be entirely the responsibility of the Société Hôtelière d'Etigny, without any additional costs being requested from the Client by the hotel.

11.2 Société Hôtelière d'Etigny will be released from any liability for the non-fulfillment of its obligations in the event of events relating to force majeure, for the duration of the force majeure event, and undertakes to all efforts reasonably necessary to limit their effects.

11.3 For the application of this Article, force majeure is understood as any event or fact that the parties could not reasonably foresee and control at the time of the reservation due to its nature external to the parties, unforeseeable and irresistible.Thus, in particular considered as cases of force majeure, in addition to those retained by the French courts and tribunals, total or partial strikes, internal or external to hotels, terrorism, wars or uprisings, bad weather, epidemics, blockage of means of transport or supply for any cause whatsoever, earthquake, fire, storm, flood, water damage, computer system failure paralyzing the normal pursuit of its activity by a Party.


  1. HEALTH REGULATIONS - HEALTH PROTOCOL

In application of the health legislation and regulations in force, the Etigny hotel undertakes, as part of its services, and in compliance with their health protocol, to comply with the various official rules and recommendations in force.

The Etigny Hotel Companyundertakes to use all possible means to preserve and ensure the health safety of its Customers and more generally of all of its partners. As a result of this obligation of means, the liability of the Société Hôtelière d'Etigny can only be incurred in the event of proven fault or negligence.

In addition and in the event that a Client acts, directly or indirectly, on his own initiative or at the instigation of a third party, in violation of the health protocol put in place by the Etigny hotel and, more generally , in violation of all the measures implemented by the establishment to comply with applicable health rules, the Société Hôtelière d'Etigny cannot be held responsible for direct or indirect damage and/or consequences of any kind resulting of such a violation.


  1. PERSONAL DATA

13.1 In application of law n°2018 – 493 of June 20, 2018 relating to the protection of personal data and the General Data Protection Regulation n°2016/679 (GDPR), the Customer is informed that the information provided during the reservation have been subject to processing of personal data for the purposes of managing reservations and Customers, billing and payment needs, as well as for commercial prospecting purposes.

In accordance with article L. 223-2 of the Consumer Code, and law n°2014-344 of March 17, 2014 relating to consumption, the Customer has the possibility of registering free of charge on the opposition list to the BLOCTEL telephone canvassing ( www.bloctel.gouv.fr ) in order to no longer be canvassed by telephone.   1. APPLICABLE LAW – MEDIATION – JURISDICTION

14.1 These General Conditions of Sale are governed by French law.

14.2 All complaints relating to the non-performance or poor performance of the Services at the Etigny hotel must be reported by the Client by registered letter with acknowledgment of receipt to:
